What Is the North Carolina Sexual Assault Statute of Limitations?

Sexual assault victims often face a long road to recovery. The trauma can affect every part of life, from physical injuries to anxiety, depression, and post-traumatic stress. Many survivors also face financial strain from medical bills, therapy costs, and lost wages when they cannot work. No amount of money can undo what happened. But a financial recovery can cover the real costs of healing and give survivors the resources they need to move forward with their lives.

Taylor Serbin Injury Lawyers understands the sensitive nature of sexual assault cases. Our team brings experience, skill, and genuine compassion to every case we handle, and we work to help survivors recover full compensation for the harm they suffered. If you or a loved one was sexually assaulted in North Carolina, you do not have to face this alone. Schedule a free consultation with our team today to learn about your legal options.

What Constitutes Sexual Assault?

Sexual assault and sexual abuse are related but not identical terms. Sexual assault generally refers to a single act or a specific incident of unwanted sexual contact against a person of any age. Sexual abuse often describes a pattern of ongoing sexual misconduct, and the term is frequently used when referring to childhood sexual abuse or abuse that occurs within a relationship of trust, such as between a caregiver and a child. Both terms describe conduct that violates a person’s body and safety, and both can support a civil lawsuit against the abuser and any responsible third parties.

Actions That May Constitute Sexual Assault or Sexual Abuse

  • Rape or attempted rape
  • Unwanted touching of a sexual nature
  • Forcing or coercing a person into sexual acts
  • Sexual exploitation of a minor
  • Indecent liberties with a child
  • Statutory rape or statutory sexual offense
  • Sexual contact facilitated by fraud, threats, or abuse of authority
  • Online sexual exploitation or grooming of a child
  • Sexual battery, including nonconsensual touching over clothing

What Should I Do After a Sexual Assault Incident?

If you or a loved one has been sexually assaulted or abused, the steps you take afterward can affect both your well-being and any future legal claim. Consider the following:

  • Get to a safe location away from the person who caused harm.
  • Seek medical attention right away, even if injuries are not obvious.
  • Contact local law enforcement to report child abuse or sexual assault.
  • Preserve any evidence, including clothing, messages, or photos.
  • Write down details of the incident while your memory is fresh.
  • Avoid contact with the abuser, including on social media.
  • Reach out to a counselor or support group for emotional support.
  • Speak with an experienced sexual assault lawyer about your legal options.

Can I Sue for Damages for Sexual Assault in North Carolina?

Justice for sexual assault does not end with a criminal case. Survivors in North Carolina can file a civil lawsuit to recover financial compensation, separate from any criminal charges filed by the state. A civil claim allows you to pursue damages from the abuser directly, and in many cases, from other parties who share responsibility, such as an employer, school, church, or other institution that failed to protect you.

Civil claims for sexual assault involve difficult evidence, emotional testimony, and strict filing deadlines. An experienced sexual abuse lawyer can help you gather evidence, identify every liable party, and file your claim before time runs out. Working with a knowledgeable attorney gives you the best chance to hold your abuser accountable and recover the compensation you deserve.

What Is the Statute of Limitations on Sexual Assault Claims in North Carolina?

The North Carolina sexual assault statute of limitations depends on your age at the time of the abuse and whether you are pursuing a criminal case or a civil lawsuit.

Criminal cases: Most sexual offenses in North Carolina, including rape, statutory rape, and indecent liberties with a child, are classified as felony sexual offenses. North Carolina does not place a time limit on felony prosecutions, so a sex offender can face criminal charges no matter how much time has passed. Misdemeanor child abuse and other misdemeanor criminal actions related to sexual battery generally must be charged within two years.

Civil cases: The civil statute of limitations works differently from the criminal timeline.

  • Adult survivors of sexual assault generally have three years from the date of the most recent incident to file a civil lawsuit, under N.C.G.S. § 1-52(16).
  • Survivors of childhood sexual abuse have until their 28th birthday to file a civil action, under N.C.G.S. § 1-17(d). This extended deadline came from the 2019 SAFE Child Act (Sexual Assault Fast Reporting and Enforcement Act), which significantly expanded protections for childhood sexual abuse survivors.
  • The SAFE Child Act also opened a temporary revival window from January 1, 2020, through December 31, 2021, which allowed some previously time-barred claims to be filed. That window has since closed.
  • Under N.C.G.S. § 1-17(e), a survivor of childhood sexual abuse may also have two years from the date of a related felony sexual offense conviction to file a civil action, which can extend the filing deadline in some cases.
  • North Carolina courts have also applied the discovery rule in certain cases, meaning the clock may not start until a victim reasonably discovers the abuse and the harm it caused.

Because these deadlines vary based on individual circumstances, sexual abuse claims should be reviewed by a lawyer as soon as possible. Waiting too long can permanently bar a valid claim.

Who Can Be Held Liable in Sexual Assault Claims in North Carolina?

Liability in a sexual assault case is not always limited to the person who committed the assault. Depending on the facts, several parties may share legal responsibility.

The Abuser

The individual who committed the sexual assault or abuse is typically the primary defendant in a civil lawsuit.

Employers

An employer may be liable if an employee committed the assault while on the job, or if the employer knew of a risk and failed to act.

Schools and Daycare Facilities

Schools, daycare centers, and youth programs can be held liable if staff failed to properly supervise children or ignored warning signs of abuse.

Religious and Youth Organizations

Churches, camps, and other organizations may face liability if they placed an abuser in a position of trust or covered up known abuse.

Landlords and Property Owners

Property owners may be liable if inadequate security allowed an assault to occur on their premises.

How Much Is a Sexual Assault Case Worth in North Carolina?

Every sexual assault case is different, and the value of a claim depends on the severity of the abuse, its lasting effects, and the financial losses involved. A sexual abuse lawsuit may allow you to recover compensation for:

  • Medical expenses, including therapy and counseling costs
  • Emotional distress and pain and suffering
  • Lost wages and reduced earning capacity
  • Costs associated with relocation or safety measures
  • Punitive damages, in cases involving egregious conduct
  • Loss of enjoyment of life
