What Causes Motorcycle Accidents in Rock Hill?

There are a variety of causes of motorcycle accidents, but many of them are unfortunately due to other car drivers on the road failing to see the motorcyclist. Bikes are smaller in size than cars, and many drivers may not be on the lookout for these smaller vehicles on the road. Other causes of motorcycle accidents are things like inclement weather creating slippery road surfaces, and dangerously sharp turns.

Who is at Fault in a Motorcycle Accident in Rock Hill, South Carolina?

Thankfully, South Carolina is an at-fault state, meaning that the person who caused your injuries is responsible for paying you compensation for the accident. Determining the cause and who is at fault for the motorcycle accident may be easy, or it may take a little more digging and fighting. Medical bills from a serious injury can pile up quickly, so it is important to hire an attorney so that they can work towards getting the insurance company to accept liability for the motorcycle accident.

What are the Survival Odds for Motorcycle Accidents?

Due to the lack of protection like a standard vehicle on the road, per vehicle mile traveled, fatalities occurred 26 times more frequently in motorcycle accidents than in passenger car crashes. Severe injuries are much more common in the event of a motorcycle accident. Motorcycle accidents can create serious injuries for the rider. Common motorcycle accident injuries include:

  • Traumatic brain injuries
  • Road rash
    • Road rash is common when a bike goes down and skids on the pavement. Wearing protective safety gear like padded pants, jackets, gloves, and boots will protect your skin in the event of a motorcycle crash
  • Internal bleeding
    • Internal bleeding can occur after a serious impact and is easy to miss when there are multiple injuries as it’s not easily apparent.
  • Broken bones
    • Broken bones aren’t an uncommon result of an accident, either. Wearing protective safety gear can help prevent broken bones in some instances.
  • Fatal injuries
    • Unfortunately, motorcycle accidents can create such serious injury in the rider that it results in death. If you lost a loved one due to a serious motorcycle crash, compensation can be sought to cover funeral and burial expenses.

Is it Worth Getting a Motorcycle Lawyer in Rock Hill?

Yes. Having a great legal team on your side can help you recover maximum compensation versus trying to handle the case on your own, or hiring an attorney who is not experienced with motorcycle cases. A motorcycle accident can be devastating to everyone involved, especially the rider. Your focus should be on recovering from your injuries that the accident caused, instead of trying to handle the complicated process of attempting to recover damages from an insurance company. Personal injury claims can be stressful. Insurance companies are known to try and settle quickly and cheaply, by offering small settlements right away. That’s why it is important to hire an experienced motorcycle lawyer, like The Law Offices of Jason E. Taylor, P.C. in Rock Hill, SC.

What is the Average Payout for a Motorcycle Accident in Rock Hill, South Carolina?

Our law firm is dedicated to getting you the compensation you deserve from your Rock Hill motorcycle accident. Every case is different. A motorcycle accident attorney will aim for a settlement amount to cover your economic damages including medical bills, lost wages, and out of pocket costs for prescriptions, and non-economic damages, which includes pain and suffering and loss of a normal life.

What is the Process to File a Claim for a Rock Hill Motorcycle Accident Case?

The process of recovering compensation from your motorcycle accident case in Rock Hill can be overwhelming. Having experienced motorcycle accident lawyers on your side is key to having smooth case development.

Gather Evidence

Gathering evidence is very important. Some of these items include the police report, photos of the vehicles involved, and photos of your injuries. Our law firm can help you gather additional evidence you may not have considered, or weren’t able to gather, due to you addressing your medical concerns following the motorcycle crash. This may include contacting law enforcement or gathering witness testimonials.

Determining Liability

Your law firm will review all of the evidence that was gathered, and help determine if you have a case. Knowledge of motorcycle laws and traffic laws is important to the review process to see which laws were broken, such as distracted driving.

Medical Treatment

Once it is determined that you have a case and liability has been accepted by the insurance company, you will focus on recovering from your injuries. During this time we will be monitoring your treatment and ensuring that you are focused on your recovery, while we handle the rest of the process. Our law firm is familiar with other cases involving motorcycle riders and motorcycle passengers in Rock Hill, South Carolina. Our motorcycle accident attorneys can request a fair settlement amount to cover medical bills, lost wages, property damage, emotional distress, loss of earning capacity, and more.

Submit Demand Package to Insurance Company

Once you have completed your medical treatment and are released from your doctor’s care, we will submit a demand package to the insurance company to begin negotiations. Your settlement is an acceptable mutually agreed-upon amount between you and the insurance company. Typically, cases can be resolved outside of court. However, if a case cannot be resolved in the pre-litigation phase, then a lawsuit must be filed. We have experienced trial attorneys at our law firm and can tackle that head-on if it comes to that.

Settlement

Our law firm is dedicated to getting you the compensation you deserve from your accident. Following your case, you will receive your settlement and you can continue to recover from your accident.

How Long Does the Claims Process in a Rock Hill Motorcycle Accident Take?

The amount of time before an agreeable settlement is reached varies by case. Your personal injury claim may take longer than others or may settle quickly. The initial settlement offer from the insurance company may come relatively quickly, and you and your personal injury attorney will discuss whether or not this is agreeable. If not, your motorcycle accident lawyer will negotiate on your behalf for an agreeable amount. If your case cannot be settled during the pre-litigation phase, then a lawsuit will need to be filed.

How Much Does a Motorcycle Accident Lawyer in Rock Hill, SC Cost?

At The Law Offices of Jason E. Taylor, P.C. in Rock Hill, SC we work on a contingency basis. What that means is we don’t bill you by the hour or ask for large payments upfront. Instead, we only get paid if we successfully recover compensation in your case. Personal injury lawyers then take a percentage of any settlement or court award to cover fees and costs.

STEPS INDIVIDUALS CAN TAKE TO HELP PROTECT PERSONAL INFORMATION

Monitor Your Accounts

Under U.S. law, a consumer is entitled to one free credit report annually from each of the three major credit reporting bureaus, Equifax, Experian, and TransUnion. To order a free credit report, visit www.annualcreditreport.com or call, toll-free, 1-877-322-8228. Consumers may also directly contact the three major credit reporting bureaus listed below to request a free copy of their credit report.

Consumers have the right to place an initial or extended “fraud alert” on a credit file at no cost. An initial fraud alert is a 1-year alert that is placed on a consumer’s credit file. Upon seeing a fraud alert display on a consumer’s credit file, a business is required to take steps to verify the consumer’s identity before extending new credit. If consumers are the victim of identity theft, they are entitled to an extended fraud alert, which is a fraud alert lasting seven years. Should consumers wish to place a fraud alert, please contact any of the three major credit reporting bureaus listed below.

As an alternative to a fraud alert, consumers have the right to place a “credit freeze” on a credit report, which will prohibit a credit bureau from releasing information in the credit report without the consumer’s express authorization. The credit freeze is designed to prevent credit, loans, and services from being approved in a consumer’s name without consent. However, consumers should be aware that using a credit freeze to take control over who gets access to the personal and financial information in their credit report may delay, interfere with, or prohibit the timely approval of any subsequent request or application they make regarding a new loan, credit, mortgage, or any other account involving the extension of credit. Pursuant to federal law, consumers cannot be charged to place or lift a credit freeze on their credit report. To request a credit freeze, individuals may need to provide some or all of the following information:

1. Full name (including middle initial as well as Jr., Sr., II, III, etc.);
2. Social Security number;
3. Date of birth;
4. Addresses for the prior two to five years;
5. Proof of current address, such as a current utility bill or telephone bill;
6. A legible photocopy of a government-issued identification card (state driver’s license or ID card, etc.); and
7. A copy of either the police report, investigative report, or complaint to a law enforcement agency concerning identity theft if they are a victim of identity theft.

Should consumers wish to place a credit freeze or fraud alert, please contact the three major credit reporting bureaus listed below:
