What to Do After a Slip and Fall in Concord, North Carolina

If you have been injured in a slip and fall accident, you should:

File a Report with the Store or Business Owner

If you have been injured in a slip and fall at a store or other business, you should file a report with the owner or manager. This report will create a record of the accident and will be significant evidence if you decide to file a personal injury claim.

Remember that following the accident, you might be asked to give a recorded statement by an insurance company. You should always seek legal representation before giving any statements to the insurance company.

The insurance company uses statements to minimize the money they have to pay out on claims. A Concord personal injury lawyer can help you avoid making statements that could damage your case.

Get the Names and Contact Information of Witnesses

If there are witnesses to your accident, it is important to get their names and contact information. These witnesses can provide valuable testimony about what happened and how it happened. This testimony can be crucial in proving your case and getting the compensation you deserve.

Take Photos of the Scene

If you are able, take photos of the scene of the accident. These photos can be used as evidence to show what caused your accident and how it happened. This evidence can be beneficial in proving your case.

Seek Medical Treatment

Make sure you seek medical treatment as soon as possible. You must ensure that your injuries are taken care of and that you are on the road to recovery. Your health is the most important thing, and you should not delay getting the care you need. Seeking medical treatment will create a record of your injuries. This will be important when it comes time to file a personal injury claim or lawsuit.

How Premises Liability Laws Apply to Your Concord Case

In North Carolina, property owners have a duty to keep their premises safe for visitors. This duty is known as the “duty of care.” If a property owner fails to live up to this duty and you are injured, you may be able to file a personal injury claim against the property owner.

There are many ways a property owner can fail to live up to the duty of care. Slip and fall accidents are one type of accident that can occur when a property owner is negligent. Other types of accidents include dog bites and more.

To succeed in a premises liability claim, you must prove that the property owner was negligent. You will also need to prove that this negligence resulted in your injuries.

Who Can I Sue For My Injuries?

The answer to this question depends on the specific facts of your case. Generally speaking, you can sue the property owner or the business owner. In some cases, you may be able to sue both.

You will need to consult with a Concord personal injury lawyer to determine who is liable for your injuries. The attorneys at the Law Offices of Jason E. Taylor have experience handling all types of premises liability claims, and we will be able to help you determine who is liable for your injuries.

Common Slip and Fall Injuries

Slip and fall accidents can result in a variety of different injuries. Some common injuries include:

  • Broken bones
  • Sprains and strains
  • Lacerations
  • Traumatic brain injuries
  • Spinal cord injuries
  • Concussions

You may be entitled to compensation if you have suffered any of these injuries in a slip and fall.

How Can I Prove That the Property Owner Was Negligent?

You will need evidence to prove that the property owner was negligent. This evidence can include:

  • Witness testimony
  • Photos of the scene of the accident
  • The police report
  • Your medical records

Common Examples of Negligence in Concord Slip and Fall Claims

There are many different ways in which a property owner can be negligent. Some common examples include:

  • Failing to clean up spills
  • Failing to repair broken stairs or sidewalks
  • Failing to maintain the premises properly
  • Failing to warn visitors of potential hazards

These are just a few examples. If you have been injured in a slip and fall, it is important to speak with an attorney to find out if you have a case.

What Damages Can I Recover in a Concord Personal Injury Claim?

If you have been injured in a Concord slip and fall accident, you may be able to recover damages for your injuries. These damages can include:

  • Medical expenses
  • Lost wages
  • Pain and suffering
  • Emotional distress

How Much Money Can I Expect to Receive?

Each slip and fall case is different, so it is difficult to say how much money you can expect to receive. The amount of money you are entitled to will depend on the specific facts of your case and the severity of your injuries.

Some factors that will be considered include:

  • The extent of your injuries
  • Your age
  • Your employment status
  • The amount of medical bills you have incurred
  • The amount of time it will take you to recover from your injuries

If you have been injured in a Concord slip and fall accident, contact the Law Offices of Jason E. Taylor today. We will review your case for free and help you determine how much money you may be entitled to.

What is the Statute of Limitations for Filing a Concord Slip and Fall Case?

In North Carolina, you have three years from the date of your accident to file a personal injury claim. You have three years from your accident to file a lawsuit against the property owner.

You will likely be barred from recovery if you do not file your claim within this time frame. So, it is important to contact an experienced personal injury attorney as soon as possible.

STEPS INDIVIDUALS CAN TAKE TO HELP PROTECT PERSONAL INFORMATION

Monitor Your Accounts

Under U.S. law, a consumer is entitled to one free credit report annually from each of the three major credit reporting bureaus, Equifax, Experian, and TransUnion. To order a free credit report, visit www.annualcreditreport.com or call, toll-free, 1-877-322-8228. Consumers may also directly contact the three major credit reporting bureaus listed below to request a free copy of their credit report.

Consumers have the right to place an initial or extended “fraud alert” on a credit file at no cost. An initial fraud alert is a 1-year alert that is placed on a consumer’s credit file. Upon seeing a fraud alert display on a consumer’s credit file, a business is required to take steps to verify the consumer’s identity before extending new credit. If consumers are the victim of identity theft, they are entitled to an extended fraud alert, which is a fraud alert lasting seven years. Should consumers wish to place a fraud alert, please contact any of the three major credit reporting bureaus listed below.

As an alternative to a fraud alert, consumers have the right to place a “credit freeze” on a credit report, which will prohibit a credit bureau from releasing information in the credit report without the consumer’s express authorization. The credit freeze is designed to prevent credit, loans, and services from being approved in a consumer’s name without consent. However, consumers should be aware that using a credit freeze to take control over who gets access to the personal and financial information in their credit report may delay, interfere with, or prohibit the timely approval of any subsequent request or application they make regarding a new loan, credit, mortgage, or any other account involving the extension of credit. Pursuant to federal law, consumers cannot be charged to place or lift a credit freeze on their credit report. To request a credit freeze, individuals may need to provide some or all of the following information:

1. Full name (including middle initial as well as Jr., Sr., II, III, etc.);
2. Social Security number;
3. Date of birth;
4. Addresses for the prior two to five years;
5. Proof of current address, such as a current utility bill or telephone bill;
6. A legible photocopy of a government-issued identification card (state driver’s license or ID card, etc.); and
7. A copy of either the police report, investigative report, or complaint to a law enforcement agency concerning identity theft if they are a victim of identity theft.

Should consumers wish to place a credit freeze or fraud alert, please contact the three major credit reporting bureaus listed below:

STEPS INDIVIDUALS CAN TAKE TO HELP PROTECT A MINOR DEPENDENT’S PERSONAL INFORMATION

Typically, credit reporting agencies do not have a credit report in a minor’s name. To find out if a minor has a credit report or to request a manual search for a minor’s Social Security number each credit bureau has its own process.
