What's On This Page

If you have been injured in an accident, it is important to know your legal rights. You may be entitled to compensation for your pain, suffering, and other damages. The lawyers at The Law Offices of Jason E. Taylor can help you recover what is rightfully yours.

We understand that it is not just the physical injuries that harm victims of personal injury accidents but also the emotional trauma they suffer. The Concord personal injury attorneys at our firm work to help victims get back on their feet after these events so they can move on with their lives.

What Can You Do in a Personal Injury Case?

Personal injury lawsuits can be filed for several reasons, but they all revolve around one central issue: negligence. Negligence occurs when someone fails to exercise the reasonable care expected from a reasonable person under the same circumstances. Negligence can take many forms, including:

  1. Driving a vehicle in an unsafe manner;
  2. Failing to repair a dangerous condition at your home or business that is not open and obvious; and
  3. Not warning others about potential hidden dangers.

The person who is injured will be considered a plaintiff in the lawsuit. The defendant is the person or company being sued for being negligent.

If you’re considering filing a lawsuit, here are some things to consider: First and foremost, talk to one of our Concord personal injury lawyers before proceeding with any formal legal action. Personal injury lawsuits are complicated matters that require precise knowledge of state and federal laws.

What’s more, it’s important to have a lawyer on your side who can help you navigate the legal system and negotiate with the insurance companies. Before proceeding with any legal action, you must fully understand your rights in any personal injury claim.

Common Personal Injury Cases in Concord, NC

There are many types of personal injury cases, but here are some of the most common.

Medical Malpractice

It can be severe when a doctor or other medical professional commits malpractice. This is when they provide incorrect information about your health condition, perform an unnecessary operation or incorrectly diagnose a problem with your body.

Motorcycle Accidents

Motorcycle accidents are some of the most common personal injury cases in Concord, NC. Motorcycles are much smaller than cars and trucks, so it is easier for drivers not to see them until it is too late. If a driver fails to yield at an intersection or makes a sudden turn without looking for oncoming traffic, the cyclist could be seriously injured.

Truck Accidents

Truck drivers and companies have state and federal regulations to follow that are designed to ensure their safety and that of other motorists. These regulations include the hours a driver can work, how much rest they must get between shifts, and when they must report for work. However, truck drivers under pressure from their employers do not always follow these laws. If you have been involved in a truck accident caused by an exhausted driver, it is essential to call an attorney right away for help.

Wrongful Death

If one or more negligent parties are at fault for causing your loved one’s death, they may be liable for any damages. The legal process can be emotionally tricky if you have lost a loved one to someone else’s carelessness. In addition to your grief, you may also face financial difficulties.

Is It Better to File a Lawsuit or Settle Outside of Court?

There are several advantages to settling a personal injury claim outside of court, including:

  1. Faster resolution
  2. More control over the process and outcome
  3. Less stress If you decide to settle your case without the time and expense of litigation

However, there are some instances where filing a lawsuit may be a better option, including:

  1. You are not able to reach an agreement with the other party
  2. Your claim has been wrongfully denied
  3. You need to recover damages that can’t be agreed upon outside of court

When you contact an attorney with The Law Offices of Jason E. Taylor, we’ll walk you through filing a personal injury lawsuit and help you decide whether this is the best option. If it is, we’ll work with you to prepare your case and file it in court.

The Statute of Limitations for Personal Injury Claims in Concord, NC

The statute of limitations for personal injury claims in North Carolina is usually three years. Therefore, you have three years from your injury to settle your claim or file a lawsuit against those responsible.

If you wait longer than this period has passed, you will not be able to recover any damages or compensation, no matter how severe your injuries or how much they have affected your life. That is why it’s important to talk to your lawyer about the statute of limitations in your specific case as soon as possible.

Compensation in Concord Personal Injury Lawsuits

If you are injured in a car accident, you may have questions about what compensation you may be entitled to. You may wonder if your insurance company will cover all of your medical bills or if you will need additional help with your expenses.

Here are some common types of compensation in personal injury cases:

Medical Expenses

The medical bills resulting from an accident can quickly add up to tens of thousands of dollars, especially if they include long-term care costs or other medical expenses relating to treatment. If you suffered any injuries related to this accident, you might be entitled to reimbursement for those costs under North Carolina law.

Lost Wages

If you missed work due to your injuries, then you may be able to recover lost wages as part of your settlement or trial judgment against the person responsible for causing the accident. Lost wages include any income personal injury victims lose due to missing work after getting hurt in an accident.

For example, car accident victims often suffer traumatic brain injuries, whiplash, or broken bones that require extensive medical treatment. These injuries can also contribute to extended recovery periods and may prevent them from returning to work. If this happens, you may be entitled to compensation for lost wages, including past and future earnings potential.

Damage to Property

If there was damage to your property, such as a bike or car, due to the accident, you should be able to recover damages for those losses.

If you have suffered damages due to an accident, then it is important that you contact a personal injury lawyer right away. It would be best if you had experienced legal advice before making any decisions or signing anything related to your case.

STEPS INDIVIDUALS CAN TAKE TO HELP PROTECT PERSONAL INFORMATION

Monitor Your Accounts

Under U.S. law, a consumer is entitled to one free credit report annually from each of the three major credit reporting bureaus, Equifax, Experian, and TransUnion. To order a free credit report, visit www.annualcreditreport.com or call, toll-free, 1-877-322-8228. Consumers may also directly contact the three major credit reporting bureaus listed below to request a free copy of their credit report.

Consumers have the right to place an initial or extended “fraud alert” on a credit file at no cost. An initial fraud alert is a 1-year alert that is placed on a consumer’s credit file. Upon seeing a fraud alert display on a consumer’s credit file, a business is required to take steps to verify the consumer’s identity before extending new credit. If consumers are the victim of identity theft, they are entitled to an extended fraud alert, which is a fraud alert lasting seven years. Should consumers wish to place a fraud alert, please contact any of the three major credit reporting bureaus listed below.

As an alternative to a fraud alert, consumers have the right to place a “credit freeze” on a credit report, which will prohibit a credit bureau from releasing information in the credit report without the consumer’s express authorization. The credit freeze is designed to prevent credit, loans, and services from being approved in a consumer’s name without consent. However, consumers should be aware that using a credit freeze to take control over who gets access to the personal and financial information in their credit report may delay, interfere with, or prohibit the timely approval of any subsequent request or application they make regarding a new loan, credit, mortgage, or any other account involving the extension of credit. Pursuant to federal law, consumers cannot be charged to place or lift a credit freeze on their credit report. To request a credit freeze, individuals may need to provide some or all of the following information:

1. Full name (including middle initial as well as Jr., Sr., II, III, etc.);
2. Social Security number;
3. Date of birth;
4. Addresses for the prior two to five years;
5. Proof of current address, such as a current utility bill or telephone bill;
6. A legible photocopy of a government-issued identification card (state driver’s license or ID card, etc.); and
7. A copy of either the police report, investigative report, or complaint to a law enforcement agency concerning identity theft if they are a victim of identity theft.

Should consumers wish to place a credit freeze or fraud alert, please contact the three major credit reporting bureaus listed below:

Consumers can obtain further information on how to file such a complaint by way of the contact information listed above. Consumers have the right to file a police report if they ever experience identity theft or fraud. STEPS INDIVIDUALS CAN TAKE TO HELP PROTECT A MINOR DEPENDENT’S PERSONAL INFORMATION
