What To Do After a Vehicle Accident

The immediate aftermath of a vehicle accident can be intense, disorienting, and stressful. This is especially true if you or a loved one are injured due to someone else’s negligence. To protect yourself and your family, it’s essential to know what to do in the event of an auto accident. Taking the proper steps quickly can also help protect any legal claims and improve your chances of recovering damages.

Here’s a quick breakdown of the critical actions you should take when you’re involved in a vehicle accident, if possible:

  • Stop your vehicle and call 911: Stay at the accident scene – leaving it is a crime. Call 911 to report the accident and any injuries and move the vehicles out of the road if possible. The police will conduct their own investigation at the scene. Their accident report can often be critical in personal injury lawsuits or insurance settlements, so make sure you request a copy.
  • Get medical attention ASAP: If you or anyone else in the accident is injured, don’t move until emergency personnel provides medical attention. Also, adrenaline can mask the pain of potentially severe injuries in the moments right after an accident, so make sure you are checked out by a doctor as quickly as possible. Be specific in explaining the accident and any injuries or problems you are experiencing. Keep all receipts related to your medical care and any copies of diagnostic images, such as X-rays.
  • Document, document, document: Get the other driver’s contact and insurance information (if they are uninsured, take down their primary address and phone number). If there are witnesses, get each one’s name, address, and contact info, and document as much of the scene as possible. Your phone is your friend here – videos, pictures, and written notes that help capture the context and conditions around your accident scene can be valuable assets in court.
  • Call The Law Offices of Jason E. Taylor: You may need a car accident lawyer to ensure that every effort is made toward a fair resolution of your claim. A cool head during this stressful experience can also help ensure you take the right next steps. Do not admit fault, sign anything, and make any statements if an insurance adjuster shows up. Instead, call your own insurance carrier after speaking to one of our experienced vehicle accident attorneys.

How Our Vehicle Accident Attorneys Can Help You Fight for Justice

It’s all-too-common for insurance companies to give accident victims the run around to avoid paying a fair settlement. If they’re not outright ignoring you, then they may be trying to bury you under a mountain of paperwork. Hiring an experienced vehicle accident lawyer lets insurance companies know that you’re serious about fighting for justice. It can also make your life a lot easier when trying to navigate a complex legal scenario.

At The Law Offices of Jason E. Taylor, we pride ourselves in providing the support and know-how you deserve. That includes:

  • Helping you find the proper medical care if you sustained injuries.
  • Gathering evidence to support your legal claim. That includes thoroughly interviewing witnesses. We conduct an independent investigation of your accident and audit all potential sources of insurance coverage. We also identify all responsible parties. This may be auto manufacturers, an at-fault driver’s employer, or government agencies responsible for road conditions, among others.
  • Handling all communications with insurance providers and opposing counsel.
  • Working with our network of experts to substantiate your claim and establish the full extent of any potential injuries and financial losses (including current losses and the impact on future earnings). Depending on your situation, those might include medical professionals, financial planners, and accident scene investigators, among others.
  • Fighting for justice – wherever that takes us. While we’re always happy to resolve a claim quickly, our lawyers are never afraid to fight for our clients in the courtroom.

Potential Compensation and Damages From a Vehicle Accident

Every accident is different, and many factors can affect the amount and type(s) of compensation you may be entitled to after a vehicle accident. Some elements could include the amount of negligence displayed by the other driver, your own level of fault in an accident, and the available assets to pay any awards or settlements.

If successful, our vehicle accident attorneys may be able to help you acquire a variety of damages in the Carolinas, including:

  • Past medical bills and the cost of any related treatments in the future
  • Lost wages and reduced earning capacity
  • Car repair or replacement costs, including any relevant car rental expenses
  • Compensation for pain, suffering, and reduced quality of life, including emotional distress related to your accident
  • Punitive damages, in rare cases of appalling negligence or misconduct

What We Are Doing. STEPS INDIVIDUALS CAN TAKE TO HELP PROTECT PERSONAL INFORMATION

Monitor Your Accounts

Under U.S. law, a consumer is entitled to one free credit report annually from each of the three major credit reporting bureaus, Equifax, Experian, and TransUnion. To order a free credit report, visit www.annualcreditreport.com or call, toll-free, 1-877-322-8228. Consumers may also directly contact the three major credit reporting bureaus listed below to request a free copy of their credit report.

Consumers have the right to place an initial or extended “fraud alert” on a credit file at no cost. An initial fraud alert is a 1-year alert that is placed on a consumer’s credit file. Upon seeing a fraud alert display on a consumer’s credit file, a business is required to take steps to verify the consumer’s identity before extending new credit. If consumers are the victim of identity theft, they are entitled to an extended fraud alert, which is a fraud alert lasting seven years. Should consumers wish to place a fraud alert, please contact any of the three major credit reporting bureaus listed below.

As an alternative to a fraud alert, consumers have the right to place a “credit freeze” on a credit report, which will prohibit a credit bureau from releasing information in the credit report without the consumer’s express authorization. The credit freeze is designed to prevent credit, loans, and services from being approved in a consumer’s name without consent. However, consumers should be aware that using a credit freeze to take control over who gets access to the personal and financial information in their credit report may delay, interfere with, or prohibit the timely approval of any subsequent request or application they make regarding a new loan, credit, mortgage, or any other account involving the extension of credit. Pursuant to federal law, consumers cannot be charged to place or lift a credit freeze on their credit report. To request a credit freeze, individuals may need to provide some or all of the following information:

1. Full name (including middle initial as well as Jr., Sr., II, III, etc.);
2. Social Security number;
3. Date of birth;
4. Addresses for the prior two to five years;
5. Proof of current address, such as a current utility bill or telephone bill;
6. A legible photocopy of a government-issued identification card (state driver’s license or ID card, etc.); and
7. A copy of either the police report, investigative report, or complaint to a law enforcement agency concerning identity theft if they are a victim of identity theft.

Should consumers wish to place a credit freeze or fraud alert, please contact the three major credit reporting bureaus listed below:

The Federal Trade Commission also encourages those who discover that their information has been misused to file a complaint with them. Consumers can obtain further information on how to file such a complaint by way of the contact information listed above. Consumers have the right to file a police report if they ever experience identity theft or fraud. Please note that in order to file a report with law enforcement for identity theft, consumers will likely need to provide some proof that they have been a victim. STEPS INDIVIDUALS CAN TAKE TO HELP PROTECT A MINOR DEPENDENT’S PERSONAL INFORMATION

Typically, credit reporting agencies do not have a credit report in a minor’s name. To find out if a minor has a credit report or to request a manual search for a minor’s Social Security number each credit bureau has its own process. To learn more about these processes or request these services, consumers may contact the credit bureaus by phone, writing, or online:
Equifax Experian TransUnion

To request information about the existence of a credit file in a minor’s name, search for a minor’s Social Security number, place a security freeze or fraud alert on a minor’s credit report (if one exists), or request a copy of a minor’s credit report consumers may be required to provide the following information:
