What is Considered a Personal Injury Claim in Monroe, NC?

A personal injury claim is a legal action taken by an injured person to recover damages for injuries suffered due to someone else’s negligence.

Valid Personal Injury Claims

Any injury caused by the careless or reckless actions of another person, company, or entity can potentially be grounds for a personal injury claim. In order to have a successful case, you must be able to prove three things:

  • That you were injured
  • That the other party was at fault
  • That you suffered damages

Cases Our Monroe Personal Injury Attorneys Handle

We can help you with the following types of injury cases:

Car Accidents

Car accidents are some of the most common personal injury claims. In 2020, there were 1,656 car crashes in Monroe, with 717 resulting in injuries and four fatalities.

If you have been in a car accident, we will investigate your case to determine who was at fault and what compensation you deserve. We also assist victims injured by drunk drivers, hit-and-run drivers, and uninsured motorists.

Boating Accidents

Boating accidents can be serious and often result in catastrophic injuries. If you have been injured in a boating accident, our lawyers can help you get the compensation you deserve for your injuries.

Defective Products

Defective products cause many serious injuries each year. If a defective product has injured you, we can help hold the manufacturer liable for your damages.

Medical Malpractice

Medical malpractice occurs when a doctor or other health care provider makes an error in treating you, and it causes serious injury or even death. Our lawyers are here to help if you have been injured by medical malpractice.

What to Expect from Your Monroe Personal Injury Case

Personal injury claims can take time, but we are committed to ensuring that you get the compensation you are owed. We will work with investigators and other experts to ensure we have a strong case for your claim.

We understand how difficult it is to be injured in an accident, which is why our focus will be on getting results as quickly as possible.

Evidence of Negligence in a Monroe Personal Injury Case

In Monroe, to prove negligence in a personal injury case, you must be able to show that the person or entity responsible for your injuries owed you a duty of care, and they breached this duty. You can also show that their breach of duty was the actual cause of your injuries, and you suffered damages as a result.

Contributory Negligence in North Carolina

In North Carolina, contributory negligence is a legal defense that can reduce or eliminate damages in a personal injury case. This means that if the plaintiff was partially responsible for their own injuries, they may not be able to recover any damages from the defendant.

For example, if you were injured in a car accident and the other driver can prove that you failed to use your turn signal or were speeding, they may try to use contributory negligence as a defense. A Monroe personal injury lawyer on our team will work to ensure that this defense is not successful.

The Personal Injury Claims Process in Monroe, NC

It is important to understand the personal injury claims process when you are injured in an accident. This can help you know what to expect and how long your case will take. The following steps are typically involved in a personal injury claim:

Initial consultation with our office – We offer free initial consultations for all potential clients so that we can better understand your case and advise you on whether we can help.

Gathering evidence – Our team will work to gather the evidence needed to prove liability in your claim. This may include photos of the accident scene, eyewitness statements, medical records, police reports, and more.

Resolving the insurance claim – We will negotiate with the insurance company on your behalf to try and get you the maximum amount of compensation possible.

Filing a lawsuit – If settlement negotiations fail, we will file a lawsuit on your behalf and take the case to court.

Receiving a verdict or settlement – When a case goes to trial, a verdict or settlement is provided. This can take several weeks or months, depending on the facts of your case.

The damages available in a personal injury lawsuit will depend on various factors, including the severity of your injuries and whether you are able to return to work after your accident.

Types of Damages That We Can Recover For You

A number of damages may be available in a personal injury lawsuit, including compensatory damages and punitive damages. Compensatory damages are meant to compensate you for your injuries, while punitive damages are awarded as punishment for the defendant’s actions.

The damages we can recover for you include:

  • Medical bills
  • Property damage
  • Lost wages
  • Pain and suffering
  • Mental anguish
  • Loss of enjoyment of life
  • Emotional distress

We will work to ensure that you receive the full amount of damages that you are entitled to.

What is the Statute of Limitations on Personal Injury Claims in Monroe?

The statute of limitations is the amount of time you have to file a lawsuit after an injury accident. In North Carolina, the statute of limitations for personal injury claims is three years. This means that you have three years from the date of your accident to file a lawsuit. If you do not file a lawsuit within this time frame, you could lose the right to get compensation for your injuries.

How Long Does it Take to Settle a Personal Injury Case?

Every claim is different, which means that some cases may resolve more quickly than others. The time it takes to settle your case will depend on various factors, including insurance coverage and the amount of damages being claimed.

An experienced personal injury attorney at The Law Offices of Jason E. Taylor will work to resolve your case as quickly as possible. Still, we understand that some cases may take a little longer.

STEPS INDIVIDUALS CAN TAKE TO HELP PROTECT PERSONAL INFORMATION

Monitor Your Accounts

Under U.S. law, a consumer is entitled to one free credit report annually from each of the three major credit reporting bureaus, Equifax, Experian, and TransUnion. To order a free credit report, visit www.annualcreditreport.com or call, toll-free, 1-877-322-8228. Consumers may also directly contact the three major credit reporting bureaus listed below to request a free copy of their credit report.

Consumers have the right to place an initial or extended “fraud alert” on a credit file at no cost. An initial fraud alert is a 1-year alert that is placed on a consumer’s credit file. Upon seeing a fraud alert display on a consumer’s credit file, a business is required to take steps to verify the consumer’s identity before extending new credit. If consumers are the victim of identity theft, they are entitled to an extended fraud alert, which is a fraud alert lasting seven years. Should consumers wish to place a fraud alert, please contact any of the three major credit reporting bureaus listed below.

As an alternative to a fraud alert, consumers have the right to place a “credit freeze” on a credit report, which will prohibit a credit bureau from releasing information in the credit report without the consumer’s express authorization. The credit freeze is designed to prevent credit, loans, and services from being approved in a consumer’s name without consent. However, consumers should be aware that using a credit freeze to take control over who gets access to the personal and financial information in their credit report may delay, interfere with, or prohibit the timely approval of any subsequent request or application they make regarding a new loan, credit, mortgage, or any other account involving the extension of credit. Pursuant to federal law, consumers cannot be charged to place or lift a credit freeze on their credit report. To request a credit freeze, individuals may need to provide some or all of the following information:

1. Full name (including middle initial as well as Jr., Sr., II, III, etc.);
2. Social Security number;
3. Date of birth;
4. Addresses for the prior two to five years;
5. Proof of current address, such as a current utility bill or telephone bill;
6. A legible photocopy of a government-issued identification card (state driver’s license or ID card, etc.); and
7. A copy of either the police report, investigative report, or complaint to a law enforcement agency concerning identity theft if they are a victim of identity theft.

Should consumers wish to place a credit freeze or fraud alert, please contact the three major credit reporting bureaus listed below:
