The Importance of Hiring a Car Accident Attorney

Suffering injuries and property damage due to a car accident can be overwhelming, and dealing with insurance companies can be complex and frustrating. That’s where a car accident attorney in Lenoir, NC, can provide invaluable assistance. Our skilled attorneys will guide you through the legal process, ensuring your rights are protected and fighting to secure the compensation you deserve.

Understanding Car Accident Laws in Lenoir, NC

Navigating the legal landscape after a car accident requires a solid understanding of the relevant laws. In Lenoir, NC, car accident cases are governed by negligence laws. North Carolina law states that if a person’s negligent actions caused the car accident and resulting injuries, they can be held liable for the damages. However, North Carolina is one of a few states that follows pure contributory negligence, which means that if the injured party was at all responsible for also causing the accident, they would recover nothing. Hiring an experienced car accident attorney like the attorneys at The Law Offices of Jason E. Taylor ensures that your rights are protected under North Carolina laws, and enables the attorneys to build a strong case on your behalf.

Steps to Take After a Car Accident

Immediately following a car accident, it’s crucial to take certain steps to protect your interests and gather evidence. First and foremost, ensure everyone involved is safe and call for medical assistance if necessary. Contact the police to file an accident report and exchange information with the other party. Additionally, gather photographic evidence, take note of witness statements, and seek medical attention, even if your injuries seem minor. Consulting with a car accident attorney as soon as possible is also highly recommended.

Gathering Evidence to Strengthen Your Case

Building a strong case requires compelling evidence to support your claims. Your car accident attorney will assist you in gathering crucial evidence, such as police reports, medical records, eyewitness testimonies, and photographs of the accident scene and your injuries. In addition, if you suffered lost wages due to your injuries, your attorney will assist you in gathering documentation to support your lost wage claim. This evidence will help establish the liability of the responsible party and demonstrate the extent of your damages so that you are receiving full and fair compensation for your losses.

Negotiating with Insurance Companies

Dealing with insurance companies can be challenging, as their primary goal is to minimize payouts. It’s important to remember that they are not on your side and may attempt to offer a settlement that falls short of what you deserve. An experienced car accident attorney will negotiate with insurance companies on your behalf, ensuring your rights are protected and maximizing your chances of receiving fair compensation.

Filing a Lawsuit: When Litigation Becomes Necessary

In some cases, negotiations with insurance companies may reach an impasse, or your claim may be denied, and filing a lawsuit becomes necessary to seek the compensation you deserve. A car accident attorney will guide you through the litigation process, representing your interests in court and presenting a compelling case to the judge and jury.

STEPS INDIVIDUALS CAN TAKE TO HELP PROTECT PERSONAL INFORMATION

Monitor Your Accounts

Under U.S. law, a consumer is entitled to one free credit report annually from each of the three major credit reporting bureaus, Equifax, Experian, and TransUnion. To order a free credit report, visit www.annualcreditreport.com or call, toll-free, 1-877-322-8228. Consumers may also directly contact the three major credit reporting bureaus listed below to request a free copy of their credit report.

Consumers have the right to place an initial or extended “fraud alert” on a credit file at no cost. An initial fraud alert is a 1-year alert that is placed on a consumer’s credit file. Upon seeing a fraud alert display on a consumer’s credit file, a business is required to take steps to verify the consumer’s identity before extending new credit. If consumers are the victim of identity theft, they are entitled to an extended fraud alert, which is a fraud alert lasting seven years. Should consumers wish to place a fraud alert, please contact any of the three major credit reporting bureaus listed below.

As an alternative to a fraud alert, consumers have the right to place a “credit freeze” on a credit report, which will prohibit a credit bureau from releasing information in the credit report without the consumer’s express authorization. The credit freeze is designed to prevent credit, loans, and services from being approved in a consumer’s name without consent. However, consumers should be aware that using a credit freeze to take control over who gets access to the personal and financial information in their credit report may delay, interfere with, or prohibit the timely approval of any subsequent request or application they make regarding a new loan, credit, mortgage, or any other account involving the extension of credit. Pursuant to federal law, consumers cannot be charged to place or lift a credit freeze on their credit report. To request a credit freeze, individuals may need to provide some or all of the following information:

1. Full name (including middle initial as well as Jr., Sr., II, III, etc.);
2. Social Security number;
3. Date of birth;
4. Addresses for the prior two to five years;
5. Proof of current address, such as a current utility bill or telephone bill;
6. A legible photocopy of a government-issued identification card (state driver’s license or ID card, etc.); and
7. A copy of either the police report, investigative report, or complaint to a law enforcement agency concerning identity theft if they are a victim of identity theft.

Should consumers wish to place a credit freeze or fraud alert, please contact the three major credit reporting bureaus listed below:

STEPS INDIVIDUALS CAN TAKE TO HELP PROTECT A MINOR DEPENDENT’S PERSONAL INFORMATION
