Why Do I Need a Personal Injury Attorney in Gastonia, NC?

If you have been injured due to the negligence of another party, it is important that you speak with an experienced personal injury attorney as soon as possible. While many people think they can handle their own case without legal representation, there are actually several advantages to having an attorney.

An experienced personal injury lawyer will know the ins and outs of the legal system and will be able to guide you through the process. They will also have a network of experts they can rely on to help build your case.

Most importantly, an attorney will fight for you when it comes time to negotiate a settlement. Insurance companies may try to settle your claim for as little money as possible, but an attorney will help you get the maximum amount of compensation available under the law.

Cases Our Personal Injury Attorneys Handle

Our Gastonia lawyers represent a variety of personal injury and wrongful death cases. Some of the most common personal injury claims we handle are:

Car Accidents

Auto accidents are the most common cause of personal injury claims in North Carolina. According to the North Carolina Department of Transportation data, over 3,000 car crashes occurred in Gastonia in 2019.

If you have been injured in a car accident in Gastonia, contact one of our accident lawyers. They can help you fight for the damages you deserve after an injury caused by a car crash.

Motorcycle Accidents

According to NHTSA, most motorcycle-vehicle collisions occur at intersections. Many car collisions with motorcycles occur because the automobile driver did not see the motorcycle. Drivers are looking for cars and trucks and often fail to register a motorcycle’s much smaller outline and rider.

Bicycle Accidents

Bicycle accidents are on the rise in North Carolina and often result in serious injury for cyclists. We can help you file a claim against the negligent driver who caused your accident and get the financial compensation you need.

Trucking Accidents

Trucking accidents are very different from car accidents. If you have been involved in an accident involving a truck or large commercial vehicle, you need a seasoned legal team on your side.

Medical Malpractice

Medical malpractice includes errors during surgery, incorrect diagnosis or treatment, and prescription mistakes. Our lawyers can help you determine if you have a valid medical malpractice claim and guide you through the process of filing a lawsuit.

How Can Our Gastonia Personal Injury Lawyers Help You?

If you have been injured in an accident, speaking with one of our attorneys can help you determine whether or not you have a case. They will review the details of your accident and injuries to see if they qualify for financial compensation under civil law.

Investigate Your Case

Our attorneys handle all aspects of your claim on your behalf so that you can focus on healing and recovery. They will work to collect all of the evidence in your case, including medical records, police reports, photos and videos of the accident scene, eyewitness statements, and more.

Negotiate Your Settlement

Our lawyers are skilled negotiators who understand how insurance companies operate. When they approach an insurance company with a claim on behalf of one of their clients, they know how to get the best results for that client. In many cases, this means securing a fair and full settlement without going to court.

Take Your Case to Trial

However, if a settlement cannot be reached, our attorneys are prepared to take your case all the way to trial. We have a proven track record of success in personal injury cases and will fight tirelessly to get you the compensation you deserve.

How to File a Personal Injury Claim in Gastonia, NC

If you were injured in an accident, you would first need to file a personal injury claim. In North Carolina, victims have three years from the date of their injury to file a lawsuit. While it may not be necessary for your case to move forward, this deadline cannot get missed.

If you decide to file a lawsuit, it will be up to your personal injury lawyer to prove that the other party was negligent and caused your injuries. This can be done by providing evidence such as witness testimony, medical records, and police reports.

Once your lawyer has filed the necessary paperwork and started building your case, it is important that you do not talk to the insurance company without your lawyer present. Insurance companies will try to trick you into saying something that could be used against you in court, so it is important that they only speak with your lawyer.

If you decide to file a personal injury claim in Gastonia, our attorneys can help you every step of the way. We will work to get you the financial compensation you deserve for your injuries and losses.

STEPS INDIVIDUALS CAN TAKE TO HELP PROTECT PERSONAL INFORMATION

Monitor Your Accounts

Under U.S. law, a consumer is entitled to one free credit report annually from each of the three major credit reporting bureaus, Equifax, Experian, and TransUnion. To order a free credit report, visit www.annualcreditreport.com or call, toll-free, 1-877-322-8228. Consumers may also directly contact the three major credit reporting bureaus listed below to request a free copy of their credit report.

Consumers have the right to place an initial or extended “fraud alert” on a credit file at no cost. An initial fraud alert is a 1-year alert that is placed on a consumer’s credit file. Upon seeing a fraud alert display on a consumer’s credit file, a business is required to take steps to verify the consumer’s identity before extending new credit. If consumers are the victim of identity theft, they are entitled to an extended fraud alert, which is a fraud alert lasting seven years. Should consumers wish to place a fraud alert, please contact any of the three major credit reporting bureaus listed below.

As an alternative to a fraud alert, consumers have the right to place a “credit freeze” on a credit report, which will prohibit a credit bureau from releasing information in the credit report without the consumer’s express authorization. The credit freeze is designed to prevent credit, loans, and services from being approved in a consumer’s name without consent. However, consumers should be aware that using a credit freeze to take control over who gets access to the personal and financial information in their credit report may delay, interfere with, or prohibit the timely approval of any subsequent request or application they make regarding a new loan, credit, mortgage, or any other account involving the extension of credit. Pursuant to federal law, consumers cannot be charged to place or lift a credit freeze on their credit report. To request a credit freeze, individuals may need to provide some or all of the following information:

1. Full name (including middle initial as well as Jr., Sr., II, III, etc.);
2. Social Security number;
3. Date of birth;
4. Addresses for the prior two to five years;
5. Proof of current address, such as a current utility bill or telephone bill;
6. A legible photocopy of a government-issued identification card (state driver’s license or ID card, etc.); and
7. A copy of either the police report, investigative report, or complaint to a law enforcement agency concerning identity theft if they are a victim of identity theft.

Should consumers wish to place a credit freeze or fraud alert, please contact the three major credit reporting bureaus listed below:

STEPS INDIVIDUALS CAN TAKE TO HELP PROTECT A MINOR DEPENDENT’S PERSONAL INFORMATION
