All these factors can add up, leaving you with a significant financial burden.

  • Medical expenses

Wrongful Death

Unfortunately, some accidents are fatal. If you have lost a loved one to a serious injury caused by someone else’s negligence, our team can help you file a wrongful death claim. Our lawyers know how South Carolina’s wrongful death laws work, and we understand how devastating it is to lose a loved one. Our team is full of compassionate attorneys who will help you through this difficult time.

Who is Liable for My Injuries?

A premises liability lawsuit is based on the theory of negligence. This means that the person who caused your accident was careless and did not take the necessary precautions to prevent it. To recover compensation, we must prove that the other party was negligent in causing your accident.

Determining who is liable for your accident is not always simple. That’s why it’s important to have an experienced lawyer on your side. Our team will investigate your accident, gather evidence, and help you identify the responsible parties.

Examples of Property Owner Negligence

There are many different ways property owners can be negligent. Some common examples include:

  • Failing to maintain the property in a safe condition
  • Failing to repair known hazards on the property
  • Failing to warn visitors of known or potential dangers on the property
  • Allowing dangerous conditions to exist on the property
  • Constructing unsafe buildings or structures
  • Failing to provide adequate security
  • Poor lighting
  • Failure to restrain or warn of an animal
  • Uneven or cracked sidewalks

Whether you know it or not, we see examples of these types of negligence daily. The broken light in the grocery store, cracked sidewalks outside the mall, or even the lack of security cameras in a parking garage are all examples of property owner negligence.

Most of the time, they have no impact on us. But when they do, the consequences can be devastating. If you have been injured in an accident caused by someone else’s negligence, contact a lawyer at The Law Offices of Jason E. Taylor today.

How to Prove Negligence in a Premises Liability Claim

Four elements must be present to prove negligence:

  1. Duty – The property owner or occupier owed you a duty of care. This means they were required to take steps to keep you safe from foreseeable hazards.
  2. Breach – The property owner or occupier breached their duty of care by failing to take the necessary precautions to keep you safe.
  3. Causation – The property owner or occupier’s breach of duty caused your accident and injuries.
  4. Damages – You suffered damages as a result of the accident, such as medical bills, lost wages, or pain and suffering.

The most common example of establishing these elements is if you were injured in a slip and fall accident. You may have fallen because of a slippery floor or an object in your path. The property owner or occupier owed you a duty of care to keep the premises safe. They breached that duty by failing to clean up the spill or remove the obstacle.

As a result, you fell and were injured. Due to your injury, you may have to miss time from work and visit the doctor. If you can prove that the property owner or occupier was negligent in causing your accident, you may be entitled to compensation for your injuries.

Time Limits for Liability Claims in Columbia, SC

South Carolina has a three-year statute of limitations for most personal injury claims, including premises liability claims. This means the clock starts on the day of your injury. If you do not file your claim within three years, your case will be dismissed.

STEPS INDIVIDUALS CAN TAKE TO HELP PROTECT PERSONAL INFORMATION

Monitor Your Accounts

Under U.S. law, a consumer is entitled to one free credit report annually from each of the three major credit reporting bureaus, Equifax, Experian, and TransUnion. To order a free credit report, visit www.annualcreditreport.com or call, toll-free, 1-877-322-8228. Consumers may also directly contact the three major credit reporting bureaus listed below to request a free copy of their credit report.

Consumers have the right to place an initial or extended “fraud alert” on a credit file at no cost. An initial fraud alert is a 1-year alert that is placed on a consumer’s credit file. Upon seeing a fraud alert display on a consumer’s credit file, a business is required to take steps to verify the consumer’s identity before extending new credit. If consumers are the victim of identity theft, they are entitled to an extended fraud alert, which is a fraud alert lasting seven years. Should consumers wish to place a fraud alert, please contact any of the three major credit reporting bureaus listed below.

As an alternative to a fraud alert, consumers have the right to place a “credit freeze” on a credit report, which will prohibit a credit bureau from releasing information in the credit report without the consumer’s express authorization. The credit freeze is designed to prevent credit, loans, and services from being approved in a consumer’s name without consent. However, consumers should be aware that using a credit freeze to take control over who gets access to the personal and financial information in their credit report may delay, interfere with, or prohibit the timely approval of any subsequent request or application they make regarding a new loan, credit, mortgage, or any other account involving the extension of credit. Pursuant to federal law, consumers cannot be charged to place or lift a credit freeze on their credit report. To request a credit freeze, individuals may need to provide some or all of the following information:

1. Full name (including middle initial as well as Jr., Sr., II, III, etc.);
2. Social Security number;
3. Date of birth;
4. Addresses for the prior two to five years;
5. Proof of current address, such as a current utility bill or telephone bill;
6. A legible photocopy of a government-issued identification card (state driver’s license or ID card, etc.); and
7. A copy of either the police report, investigative report, or complaint to a law enforcement agency concerning identity theft if they are a victim of identity theft.

Should consumers wish to place a credit freeze or fraud alert, please contact the three major credit reporting bureaus listed below:

Consumers have the right to file a police report if they ever experience identity theft or fraud. STEPS INDIVIDUALS CAN TAKE TO HELP PROTECT A MINOR DEPENDENT’S PERSONAL INFORMATION

Typically, credit reporting agencies do not have a credit report in a minor’s name. To find out if a minor has a credit report or to request a manual search for a minor’s Social Security number each credit bureau has its own process.
